Appeal Court Reverses Order Deregistering ADC, Four Other Parties

The Court of Appeal in Abuja has overturned a Federal High Court judgment that directed the Independent National Electoral Commission (INEC) to deregister the African Democratic Congress (ADC) and four other political parties. The appellate court ruled that the lower court lacked the jurisdiction to entertain the case, effectively restoring the legal status of the affected parties.

Delivering its judgment, the appellate court held that the Federal High Court erred in ordering the deregistration of the political parties. The ruling set aside the earlier decision, reaffirming that the affected parties remain legally recognised and are entitled to continue their political activities under Nigeria's electoral laws.

The case stemmed from a suit that sought the deregistration of the ADC and four other parties over issues relating to their legal status. However, the Court of Appeal found merit in the appeals filed by the parties and INEC, concluding that the trial court acted outside its powers in issuing the deregistration order.

The judgment is expected to have significant implications ahead of the 2027 general elections, as it removes the uncertainty surrounding the participation of the affected political parties. It also reinforces the appellate court's earlier intervention, which had suspended the enforcement of the lower court's ruling pending the determination of the appeals.

Political observers say the decision provides clarity for INEC and the affected parties as preparations for future elections continue, while reaffirming the importance of due process in matters concerning the registration and deregistration of political parties.
