Court Rejects El-Rufai’s Bid to Stop ICPC From Freezing His Accounts
A Federal High Court in Abuja dismisses Nasir El-Rufai’s suit seeking to prevent anti-corruption agencies from freezing accounts or seizing assets.
A Federal High Court in Abuja has dismissed a suit filed by former Kaduna State Governor Nasir El-Rufai seeking to stop the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and other agencies from freezing his bank accounts or seizing his assets.
Justice Joyce Abdulmalik dismissed the case on Thursday after ruling that it amounted to an abuse of court process.
El-Rufai had listed the ICPC, Economic and Financial Crimes Commission (EFCC), Department of State Services (DSS) and the Attorney-General of the Federation as respondents in the suit.
The former governor sought an order preventing the agencies from taking steps to freeze his accounts or seize his assets.
However, the respondents challenged the action, arguing that similar cases had already been instituted before the Federal Capital Territory High Court and the Federal High Court.
Justice Abdulmalik agreed with the respondents’ position that the suit constituted an abuse of court process and dismissed it.
The ruling represents a procedural decision on the suit before the court. It does not, by itself, establish that the allegations or matters under investigation by the agencies have been proven.
The ICPC and other anti-corruption agencies have powers under relevant laws to investigate suspected offences and pursue appropriate legal measures. Any freezing of accounts or seizure of assets remains subject to applicable legal requirements and court processes.
El-Rufai, who governed Kaduna State from 2015 to 2023, has faced scrutiny from public authorities over matters connected to his time in office. The details and status of any separate investigations or proceedings must be distinguished from the court’s decision to dismiss this particular suit.
The dismissal means El-Rufai did not obtain the order he sought in this case to restrain the agencies from freezing his accounts or seizing assets.
The ruling also highlights the importance of courts examining whether litigation is properly brought, particularly where similar proceedings have already been filed before other courts.
Further developments may depend on any separate legal proceedings involving the parties and whether El-Rufai pursues any available legal options concerning the ruling.
The case is part of a wider series of legal and accountability questions involving former public officials and anti-corruption agencies. However, the outcome of this suit should not be treated as a final determination of the merits of any separate allegations against the former governor.
